John Deere Quilt
Question about making quilts to sell….?
I want to start making quilts to sell, online eventually, but first in stores locally. My question is, if I use a pattern from a book or website, can I sell the quilt or will that be violating a copyright? Also, if I use licensed fabrics (like Disney or John Deere or NFL team fabrics), can I still sell the quilt? Please help!
You will need permission for some patterns.
Old standards are free to use – public domain; openly available to everyone and not subject to copyright protection.
I ask the designer in writing (email) so I have a written response.
Using licensed fabric is often said to be a violation, but has been found in several courts* that since the fabric was already sold, first to the retailer and then to the customer, the copyright is no longer valid.
Some merchants may not see it this way and some may.
Make sure what you offer for sale is clearly noted that the product in whole is not a licensed product – not an item that is sold only by a franchise or company, such as Disney.
